Anovia Payments Pty Limited ABN 54 615 109 585 (“Anovia”) believes it is important to protect and respect the privacy of its customers and users. Anovia is bound by the Privacy Act 1988 (as amended) and the Australian Privacy Principles (collectively, “Privacy Law”). This Privacy Policy describes Anovia’s policies and practices on the collection and use of your personal and corporate information when you register for and use any of Anovia’s products and services (collectively, the “Services”), and other requirements as set out in the Privacy Law.

Collection of Information

In order to use the Services, Anovia requires certain personal and corporate information. Anovia collects corporate information, including your company name, website, email address, type of business, bank account and ABN. Anovia also collects personal information such as your name, email address, telephone number, address, and date of birth.

Anovia has subsidiaries in the U.S.A. and Canada and so it may disclose your personal and corporate information to recipients in these regions. Anovia may notify you, by amending this Privacy Policy or otherwise, should Anovia disclose any personal information to any other jurisdiction. If Anovia notifies you of such disclosure, it will advise you of the country in which the overseas recipient is located.

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. Anovia uses cookies on its Site. Third Parties

Anovia uses third parties to provide the essential links between the merchants, the banks and itself in order to provide the Services. When you sign up for a Service, Anovia will share your merchant account details as necessary for the third party to provide that Service.

These third parties are prohibited from using your personally identifiable information for any other purpose.

Anovia does not share any information with third parties for any unknown or unrelated uses.

Clear Gifs Information (Web Beacons/Web Bugs)

Anovia may employ a software technology called clear gifs (a.k.a. web beacons/web bugs), that helps Anovia better manage content on the Site by informing it of what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on web pages. Anovia does not tie the information gathered by clear gifs to its customers’ personally identifiable information.

Anovia reserves the right to disclose your personal information as required or permitted by law (including Privacy Law) and when Anovia believes that disclosure is necessary to protect its rights and/or comply with a judicial proceeding, court order, or legal process.

Customer Testimonials

Anovia may post customer testimonials on its Site which may contain personal information such as the customer’s name. Anovia will obtain your consent to use your personal information prior to posting the testimonial. If at any time you no longer wish to have any testimonial you have provided posted on the Site you may request for it to be removed by emailing Anovia at auinfo@anoviapayments.com.au.

There are many external links on the Site. The terms and conditions set out in this Privacy Policy only cover the Site.

Storage of Collected Information

The security of your personal information is important to Anovia. When you enter sensitive information on Anovia’s registration form or merchant application, Anovia encrypts that information using secure socket layer technology (SSL).

Anovia follows generally accepted industry standards to protect the personal information submitted to it, both during transmission and once the information is received. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while Anovia strives to use commercially acceptable means to protect your personal information, Anovia cannot guarantee its absolute security.

Complaints

If you wish to lodge a complaint about Anovia’s handling of your personal information or Anovia’s compliance with this Privacy Policy or Privacy Law, you may lodge the complaint by emailing Anovia’s customer support at ausupport@anoviapayments.com.au or by contacting Anovia by telephone or postal mail at the contact information listed below.

Anovia will contact you to acknowledge your complaint as soon as possible after receiving your complaint. Anovia will investigate your complaint and provide you with a written response. If Anovia is unable to resolve your concern, you may request an independent person to investigate your complaint, such as the Privacy Commissioner.

Changes to Privacy Policy

If Anovia decides to change its privacy policy, Anovia will post those changes to this Privacy Policy, the homepage, and other places Anovia deems appropriate so that you are aware of what information Anovia collects, how Anovia uses the information, and under what circumstances, if any, Anovia discloses it. Anovia reserves the right to modify this Privacy Policy at any time, so please review it frequently. If Anovia makes material changes to this policy, Anovia will notify you here, by email, or by means of a notice on Anovia’s homepage.
